In my years of dealing in real estate transactions, one thing has become clear: when you’re looking to buy a home, there is so much to consider. It can be overwhelming. There’s the property search itself, which can be exhausting. Once you find that perfect property, there’s the process of making an offer, which can be challenging at times, with the haggling over terms and conditions. Then comes the closing.
Among all of these considerations, I find the explanation and need for title insurance can easily be overlooked.
But it’s necessary nonetheless.
There are a few things I think a new property buyer should know about how to get title insurance.
You May Have Recommendations
First of all, it’s quite likely that your realtor will know a title insurance attorney (like us here at Topouzis & Associates, P.C.). Most realtors on the buyer’s side are in the business of helping their clients by getting them the best closing help possible. After all, we closing attorneys are the final link in the chain of the whole home-buying process, and property purchasers will often judge the job their realtor has done on their experience with the closing attorney (whether fair or no).This in turn aids them in getting referrals. Naturally, a purchaser of property is empowered by law to choose their own title insurance. The US Real Estate Settlement Procedures Act (RESPA) has codified the common-sense practice of a homeowner being free to choose a title insurer, whether purchasing a new property or refinancing. The rules have been written such that purchasers of property cannot be legally taken advantage of. This is as it should be.
